Terms of Service

These terms are a legal agreement between you and us. They set out the rules for using ElliottOS. Please read them carefully. By creating an account or using the service, you agree to these terms.

1. Who we are and how to contact us

ElliottOS ("ElliottOS", "we", "us" or "our") is a service provided by Jonathan Elliott, a sole trader trading as Jonny Elliott Consulting and ElliottOS, of Ground Floor Rear Barn, The Brookdale Centre, Knutsford, Cheshire, WA16 0SR. Jonathan Elliott is the data controller responsible for your personal data under the UK GDPR.

You can contact us at any time by email at support@elliottos.co.uk. If we need to contact you, we will use the email address linked to your account.

2. Eligibility

ElliottOS is only for adults. You must be at least 18 years old to create an account and use the service. By agreeing to these terms you confirm that you are 18 or over. We ask for your date of birth when you sign up so that we can confirm this. If we learn that an account belongs to someone under 18, we may suspend or close it.

You must provide accurate account information and keep it up to date. You are responsible for keeping your login details and devices secure, and for all activity that happens under your account.

3. What ElliottOS is

ElliottOS is a personal life operating system delivered as a subscription web application. It helps you bring together and organise your whole-life information across areas we call "orbits", including your health and body, your finances, your relationships and contacts, your journal, mood and notes, and your tasks, plans and goals.

ElliottOS includes Alfred, an AI life assistant. Alfred can answer questions, help you plan, summarise your information and take actions inside the app when you ask it to. Alfred is powered by third-party AI technology (see section 10). Voice features let you speak to Alfred and hear spoken replies.

4. Important: ElliottOS is not professional advice

Alfred and ElliottOS provide general wellness-grade and organisational guidance only. They do not provide medical, legal, financial, tax or other professional advice, and nothing in the service should be treated as such advice.

Information about your health, body, money, relationships or plans is provided to help you organise your life and reflect on it. It is not a diagnosis, a treatment plan, a financial recommendation, or a substitute for a qualified professional.

You remain responsible for your own decisions. Before acting on anything in ElliottOS, and in particular before making any decision about your health, medication, money or legal position, you should consult a suitably qualified professional. If you think you have a medical emergency, contact the emergency services or a medical professional straight away. Do not rely on ElliottOS or Alfred in an emergency.

5. Your subscription, price and renewal

ElliottOS is a paid subscription. The current price is £50 per month, including any VAT where it applies. Payment is taken through our payment provider, Stripe. We do not store your full card details ourselves.

Your subscription renews automatically each month on the anniversary of your sign-up, and the monthly fee is charged in advance for the coming month, until you cancel. We will let you know in advance if we change the price, and any change will apply from your next renewal after we have given you notice.

Cancelling

You can cancel at any time from within the app. When you cancel, your subscription will not renew again, and you keep access to the paid features until the end of the period you have already paid for. We do not provide pro-rata refunds for the remainder of a paid month unless the law requires it or we decide to offer one.

Your consumer cancellation right

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you normally have a right to cancel a purchase of digital services within 14 days without giving a reason. Because ElliottOS gives you access immediately when you subscribe, we ask you, at sign-up, to agree that we can start providing the service straight away. You acknowledge that once the service has been fully provided during that 14-day period you will lose the right to cancel under those Regulations. If you cancel within the 14-day period before the service has been fully provided, you may be entitled to a refund for the part not yet supplied. This does not affect your separate right to cancel your ongoing subscription at any time as described above, or any other legal rights you have.

6. Acceptable use

You agree to use ElliottOS lawfully and responsibly. In particular, you must not:

7. Your data and content

The information and content you put into ElliottOS remain yours. We do not claim ownership of it. To run the service for you, you grant us a limited, non-exclusive licence to host, store, copy, process, display and transmit your content, and to share it with the service providers described in our Privacy Policy, only as needed to operate, secure, maintain and improve ElliottOS and to provide the features you use. This licence ends when your content is deleted, except for copies we are required or reasonably need to keep for a short time or for legal reasons.

How we handle your personal information, including your health and financial data, is explained in our Privacy Policy. You can export your data and delete your account from within the app.

You are responsible for the accuracy and lawfulness of the information you enter, including any information about other people (for example contacts) that you choose to store.

8. Our intellectual property

ElliottOS, including the software, design, branding, the name "ElliottOS", the "Alfred" assistant, and all related content we provide, is owned by us or our licensors and is protected by intellectual property laws. These terms give you a personal, limited, non-transferable, non-exclusive right to use the service while your subscription is active. They do not transfer any ownership to you. You must not copy, modify, distribute, reverse engineer or create derivative works from the service except to the extent the law allows despite this restriction.

9. AI features

Alfred uses artificial intelligence to generate responses and suggestions. AI can be extremely useful, but it can also be wrong, incomplete or misleading, and it may occasionally produce inaccurate or unexpected results. You should use your own judgement, and you should not rely on Alfred for decisions that need professional advice (see section 4). We do not use your data to train AI models, and our AI providers process your data under their commercial terms without using it to train their models. More detail is in our Privacy Policy.

10. Third-party and connected services

ElliottOS relies on third-party providers to work, and lets you connect optional external services, for example your bank, your calendar, your health data or your own AI account. When you connect one of these services, your use of that service is also governed by that provider's own terms and privacy policy, which are between you and them. We are not responsible for third-party services, their availability, or their acts or omissions. You can disconnect a connected service at any time in the app.

11. Availability and "as is"

We work hard to keep ElliottOS available and reliable, but we cannot promise that the service will always be uninterrupted, error-free or secure, or that it will always be available. We may need to suspend, withdraw or restrict all or part of the service for maintenance, updates, security or operational reasons, and we will try to give reasonable notice where we can.

To the fullest extent permitted by law, the service is provided "as is" and "as available", and we do not give any warranties or guarantees that are not expressly set out in these terms. This does not affect the statutory rights you have as a consumer that cannot be excluded, including that services must be provided with reasonable care and skill.

12. Suspension and termination

You can stop using ElliottOS and close your account at any time from within the app. We may suspend or end your access if you seriously or repeatedly break these terms, if we are required to by law, if there is a risk to the security or integrity of the service or other users, or if your payment fails and is not resolved. Where it is reasonable and lawful to do so, we will give you notice first. If we close your account without good reason before the end of a paid period, we will refund the unused part of that period.

When your account ends, your right to use the service stops, and your data is handled as described in our Privacy Policy, including the recovery window before permanent deletion.

13. Our liability to you

Nothing in these terms limits or excludes our liability where it would be unlawful to do so. In particular, we do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.

Because Alfred and ElliottOS are general organisational and wellness-grade tools and not professional advice, we are not liable for decisions you make based on the information or suggestions the service provides. This does not affect your statutory rights as a consumer.

14. Changes to these terms

We may update these terms from time to time, for example to reflect changes to the service, to our providers, or to the law. If we make a significant change, we will give you reasonable notice, normally by email or a notice in the app, before it takes effect. If you do not agree to a change, you can cancel your subscription. Continuing to use the service after a change takes effect means you accept the updated terms. The "Last updated" date at the top shows when these terms were last changed.

15. Other terms

If any part of these terms is found to be invalid or unenforceable, the rest will continue to apply. If we do not enforce a right straight away, that does not mean we have given it up. You may not transfer your rights or obligations under these terms without our consent. We may transfer ours to another entity, for example if our business is reorganised, as long as this does not reduce your rights.

16. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them or the service (including non-contractual disputes or claims), are governed by the law of England and Wales. You and we agree that the courts of England and Wales have jurisdiction, although if you live in another part of the UK you may also bring proceedings in your local courts as your consumer rights allow.
